General Terms & Conditions:

Below you will find our terms and conditions for purchase. These always applies when you use or place an order through our website and contain information for you as a buyer.

 

Please read the general terms and conditions carefully.

  • Refur Rad reserves the right to make changes to these terms and conditions, to the extent as this is necessary to modify to changed legal or technical framework conditions.
  • Changes in terms and conditions will be announced to each customers by email communication to the customers email address which they have used it during their purchase from Refur Rad website and any changes are directly considered as approved if the customer does not raise an objection in text form (preferably email) within four weeks after receipt of the notification change.
  • If the customer has an objection to the change or addition to the terms and conditions, Refur Rad is entitled to refuse the user contract on the basis of these terms and conditions with a notice period of four weeks.
  • All prices stated on the website and in other material originating from Refur Rad include VAT and other levies imposed by the Federal Republic of Germany (At the moment, Sales tax is not shown because the seller is a small business owner within the meaning of the sales tax law).
  • If any shipping and delivery costs are charged, this will be clearly stated during the ordering process.
  • The content of our website has been complied with the greatest care. However in cases Refur Rad cannot guarantee that all information on the website is correct, complete, updated all the times. All prices and other information on the website and in other materials originating from Refur Rad are therefore subject to obvious programming and typographical error.
  • Refur Rad cannot accept any responsibility for any color deviations for the products as a result of screen quality.

 

Implementation of the Agreement:

  • Refur Rad is entitled to engage third parties in the during the delivery of products arising from the agreement.
  • The delivery time is in principle 7 working days. In some cases delivery might also take longer duration of 10 working days. Refur Rad only delivers once to the customer specified location during the ordering process. If the customer is not home or incorrect address, the order will be returned back to Refur Rad and the purchase amount will be refunded minus the return costs depends on the customer specified address during the ordering process.
  • If Refur Rad is unable to deliver the products within the agreed term, it will be notified to the customer accordingly through email or telephone. In that case customer can agree to a new delivery date or customers will be given the right to cancel the order for free of charge.
  • Refur Rad strictly advises the customer to inspect and verify the delivered product and to report immediately of any defects, damages, missing parts within 2 days of time from the date of delivery, preferably by email (contact@refurrad.de).
  • As soon as the product is delivered to the customer to the desired specified customer address during the ordering process, the risk with regard to the products is transferred to the customer.
  • Refur Rad is entitled to deliver a similar product of similar quality and price to the customers, if ordered product is no longer available and customer is then entitled to cancel the order free of charge and to return the product free of charge.

 

Warranty and Information:

  • Warranty only applies to the original purchaser of the product and proof of purchase is mandatory to qualify for the warranty.
  • Our warranty only covers parts that are broken or damaged and those parts will be seen as individual parts, meaning we will not change the whole bike and we will ship the replacement parts for only to those particular damaged parts. This strictly does not cover any parts that are broken or damaged, by misuse, abuse, neglect, accident or normal wear and tear.
  • In every cases Refur Rad is entitled to ask for a photo or video evidence on the broken or damaged parts from our products. After evaluation of reported broken or damage, we will send replacement of parts to you free of charge and customers will have to send us the damaged part, before we send you the replacement for the individual parts.

 

Right of withdrawal:

  • The cost for the return shipment are to be bared only by the customers and return costs depends on the customer specified address during the ordering process.
  • The Customer will only handle the product and packaging with care. Customer is only liable for depreciation of the product that is the result of a way of handling the product that goes further than permitted.

 

Payment and Information:

  • Customer can only make the payments to Refur Rad according to the payment methods indicated during ordering procedure on the website. Refur Rad is free to change or add new payment methods for customers, without any further notifications.

 

Complaint Procedure:

  • If customer has a complaint about a product in accordance with the warranty or about any other aspects, customers are free to submit a complaint to Refur Rad by e-mail (contact@refurrad.de) or post to below mentioned address.
  • Refur Rad will give a response or take action to the customer complaint immediately and resolved without any further delay. If that is not possible Refur Rad will communicate the customer regarding the complaint within 5-7 working days after receipt of the complaint.

 

Personal Data and Information:

  • Refur Rad processes the personal data of the customers in accordance with the privacy policy statement published on the website.
  • In all cases the agreement provided is governed by Federal Republic of Germany.
  • These general terms and conditions and other necessary information’s are made with accordance to mandatory German law, all disputes that may arise as a result of the agreement will be submitted to the competent Federal Republic of Germany court in the location where Refur Rad is registered.
  • If a provision in these general terms and conditions proves to be invalid, this will not affect the validity of the entire general terms and conditions. In that case, the parties will determines a new provision as a replacement, thus giving shape to the intention of the original provision as much as legally possible.
  • We have no intention to violate your rights or use your data for any other purposes than providing the best services for the users compliant to the GDPR.
